By downloading, installing, or using Daily Companion, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

1. Overview

Daily Companion ("the App") is a personal life-tracking application that helps you log moods, habits, expenses, journal entries, and other personal data. The App is provided by Gareth trading as GTLabs ("we", "us", "our"), a sole trader registered in England.

2. Eligibility

2.1 Daily Companion is intended for users aged 13 and over. By using the App, you confirm that you are at least 13 years of age.

2.2 If you are between 13 and 18, you confirm that you have your parent's or guardian's consent to use the App and that they have read and agreed to these Terms on your behalf.

3. Use of the App

You may use Daily Companion for personal, non-commercial purposes only. You agree to use the App in compliance with all applicable laws and regulations. You are solely responsible for any data you enter into the App and for any decisions you make based on information displayed within it.

4. Account and Data

Daily Companion does not require you to create an account. All content you create is stored locally on your device. You are responsible for maintaining the security of your device and any PIN or biometric lock you configure within the App.

We cannot recover lost data as we do not have access to your device or its contents. Data may be permanently lost if you uninstall the App, factory reset your device, clear the App's storage, or lose your device. We strongly recommend using the App's built-in backup feature regularly to protect against data loss.

GTLabs accepts no liability for data loss resulting from device failure, uninstallation, or failure to create backups.

5. Subscriptions and Lifetime Access

Daily Companion offers a free tier and optional premium access with additional features. Premium is available as:

Prices are shown in GBP. Your local currency equivalent may vary and will be displayed at the point of purchase.

Auto-Renewal

Monthly and annual subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your Google Play account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

Free Trial

If a free trial is offered, unused portions of the trial will be forfeited upon purchasing a subscription. The trial period is 7 days.

Lifetime Access — Definition and Scope

"Lifetime Access" means the operational lifetime of the Daily Companion App as a product — not the lifetime of the user. It grants access to premium features for as long as the App continues to be maintained and distributed by GTLabs.

5.1 Lifetime Access is a one-time, non-refundable purchase (subject to Google Play's standard refund policy and your statutory rights under the Consumer Rights Act 2015) that unlocks premium features for the duration of the App's availability.

5.2 GTLabs reserves the right to discontinue the App, cease development, or stop releasing updates at any time, provided that we give Lifetime Access holders a minimum of ninety (90) days' written notice (via email or in-app notification) before the App is formally discontinued.

5.3 In the event that Daily Companion is discontinued:

5.4 Lifetime Access does not entitle the holder to: (a) perpetual updates or new features; (b) compatibility with future hardware or operating systems; (c) any refund or compensation upon discontinuation of the App, except where required by law; or (d) transfer of the licence to another person, device account, or platform.

5.5 For the avoidance of doubt, the purchase of Lifetime Access constitutes a licence to use the premium features of the App, not a purchase of the software itself. Ownership and all intellectual property rights remain with GTLabs as set out in Section 8.

Managing Subscriptions

You can manage or cancel your subscription at any time through your device's account settings:

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that date.

Refunds

All purchases are processed through the Google Play Store. Refund requests must be directed to Google Play in accordance with their refund policy. We do not process payments or refunds directly. This does not affect your statutory rights under the Consumer Rights Act 2015.

6. Health, Wellbeing, and Medical Disclaimer

IMPORTANT: Daily Companion is NOT a medical device.

The App has not been assessed, certified, or approved by the UK Medicines and Healthcare products Regulatory Agency (MHRA), the US Food and Drug Administration (FDA), or any other medical regulatory authority. It is not intended to diagnose, treat, cure, monitor, or prevent any disease or medical condition.

6.1 The mood tracking, sleep tracking, sickness logging, health correlations, step counts, heart rate displays, and any insights or patterns provided by the App are for personal informational and self-reflection purposes only. They do not constitute medical advice, clinical diagnosis, or treatment recommendations.

6.2 You should never disregard professional medical advice or delay seeking it because of something you have read or observed in the App. Always consult a qualified healthcare professional with any questions regarding a medical condition, mental health concern, or changes to your wellbeing.

6.3 The App's sickness tracking feature is a personal logging tool only. It does not assess the severity of any illness, does not provide treatment recommendations, and should never be relied upon to determine whether you need medical attention.

7. Financial Disclaimer

The expense tracking, budgeting, and spending insights provided by Daily Companion are for personal organisational purposes only. The App does not provide financial, tax, or investment advice. No information displayed in the App should be construed as a recommendation to make or refrain from making any financial decision. You should consult a qualified financial adviser for any financial decisions.

8. Intellectual Property

8.1 All intellectual property rights in Daily Companion — including but not limited to the source code, object code, software architecture, user interface design, visual design, graphics, icons, animations, the "Daily Companion" name, the compass/journal logo, and all associated branding — are and shall remain the exclusive property of Gareth trading as GTLabs, protected by the Copyright, Designs and Patents Act 1988 and applicable international intellectual property laws.

8.2 You are granted a limited, non-exclusive, non-transferable, revocable, non-sublicensable licence to use the App on a single device for personal, non-commercial purposes only, subject to these Terms.

9. User Content

You retain full ownership of all data and content you enter into the App, including journal entries, photos, mood logs, financial records, and any other personal content. Since all data is stored locally on your device, you maintain exclusive control over your content at all times. We claim no ownership, licence, or interest in your personal content.

10. Limitation of Liability

10.1 The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, GTLabs excludes all warranties, conditions, and representations not expressly set out in these Terms.

10.2 To the maximum extent permitted by law, GTLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

10.3 Our total aggregate liability to you for any claims arising from or related to the App — including claims related to Lifetime Access purchases, monthly or annual subscriptions, or any other paid features — shall not exceed the greater of: (a) the total amount you have actually paid to GTLabs in the twelve (12) months preceding the claim; or (b) fifty pounds sterling (£50). For Lifetime Access holders, the amount paid shall be calculated as the one-time Lifetime Access fee.

10.4 To the fullest extent permitted by law, GTLabs excludes all liability not expressly assumed in these Terms.

10.5 Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under the laws of England and Wales, including your statutory rights under the Consumer Rights Act 2015.

10.6 You acknowledge that the limitations set out in this section are fair and reasonable given that the App is available free of charge (with optional paid premium features at modest cost) and that all personal content is stored locally under your sole control.

11. Indemnification

You agree to indemnify, defend, and hold harmless GTLabs (Gareth trading as GTLabs) from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your breach of these Terms; (b) your misuse of the App; (c) your violation of any applicable law or regulation; or (d) any third-party claim arising from content you create, export, or share using the App's features.

12. Digital Content Standards (Consumer Rights Act 2015)

12.1 Daily Companion is supplied as "digital content" within the meaning of the Consumer Rights Act 2015 ("CRA 2015"). We endeavour to ensure that the App is of satisfactory quality, fit for purpose, and as described.

12.2 If you believe the App contains a fault, you may be entitled to: (a) a repair or update to fix the issue; or (b) a price reduction if the fault cannot be remedied within a reasonable time.

12.3 These statutory rights apply for up to six years from the date of supply (five years in Scotland) and are not affected by anything in these Terms.

12.4 For Lifetime Access purchases: the CRA 2015 entitles you to digital content that is of satisfactory quality at the point of supply and for a reasonable period thereafter. The right to a repair or price reduction applies if the App is faulty at the time of purchase or becomes faulty due to an update we provide. However, deterioration in functionality caused solely by third-party operating system changes after discontinuation of the App (as described in Section 5) does not constitute a fault for the purposes of the CRA 2015.

12.5 Nothing in these Terms is intended to, or shall be construed as, excluding or restricting any rights you have under the CRA 2015 or any other applicable consumer protection legislation.

13. Modifications to the App and Terms

We reserve the right to modify, update, or discontinue any feature of the App at any time. We may also update these Terms of Service. Material changes will be communicated via a notice within the App. Continued use of the App after changes have been notified constitutes acceptance of the revised terms. If you do not agree with any changes, you should stop using the App.

14. Termination

14.1 You may stop using the App at any time by uninstalling it from your device.

14.2 We may terminate or suspend your access to premium features if you breach these Terms. In such cases, no refund will be provided for the remaining subscription period.

14.3 Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, Intellectual Property, and Governing Law) shall continue in full force and effect after termination.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GTLabs regarding your use of the App and supersede any prior agreements or understandings.
